PYSTACK – EVOLFY S.A. DE C.V.

This Cancellation and Refund Policy (the “Policy”) establishes the circumstances under which clients of EVOLFY S.A. de C.V. (“PYSTACK”) may cancel services and, if applicable, receive a refund.

This Policy is an integral part of the Terms and Conditions available at https://pystacklabs.com.

I. SCOPE

This Policy applies to:

  • Predefined design and prototype packages.
  • Custom and tailored services.
  • Any digital deliverables generated by PYSTACK (wireframes, prototypes, interfaces, illustrations, audits, redesigns).

Due to the professional and customized nature of PYSTACK’s services, cancellations and refunds are strictly regulated under this Policy.

II. CANCELLATIONS BEFORE SERVICE COMMENCEMENT

Clients may request cancellation only if PYSTACK has not begun any work related to the contracted service.

2.1 Applicable Refund
If the cancellation is valid (prior to service commencement), the Client may receive a refund of the amount paid, minus:

  • Administrative fees,
  • Bank or payment gateway fees, and
  • Operational costs incurred in preparing to start the project.

2.2 Timeframe
Refunds will be processed within fifteen (15) business days following confirmation of the cancellation. The credited amount will be reflected according to the policies and processing times of the bank or card issuer used for payment.

III. CANCELLATIONS AFTER SERVICE COMMENCEMENT

Once PYSTACK has started any phase of the project, a full refund is not applicable.

3.1 What constitutes service commencement?
The project is considered started upon any of the following actions:

  • Initial briefing meeting
  • Receipt or submission of startup forms or documentation
  • Preliminary research or project analysis
  • Creation of wireframes, sketches, ideas, or conceptual structures
  • Assignment of team members or professionals to the project
  • Development of schedules or work plans

3.2 Partial refund based on progress
In such cases, PYSTACK may provide only a partial refund, determined based on:

  • Hours actually worked on the project
  • Materials, resources, and tools used
  • Project progress at the time of cancellation
  • Tasks completed or partially completed

The refund will not exceed the amount corresponding to unworked portions.
Calculations are internal and based solely on the actual project progress.

3.3 Consequences of cancellation after commencement

  • Final versions, additional adjustments, or review rounds will not be delivered
  • Only work completed up to the cancellation date will be provided
  • No compensations, bonuses, or credits for future services will be issued

IV. EXCEPTIONS FOR PARTIAL REFUND

PYSTACK may authorize a partial refund, without credits or compensations, in the following cases:

  1. Verified technical impossibility, unrelated to the Client, making project completion impossible
  2. Serious breach by PYSTACK, not caused by Client delays, omissions, or lack of communication

In these cases, the partial refund will be calculated exclusively based on:

  • Stage completed
  • Work delivered or pending delivery
  • Hours actually worked

V. CUSTOM SERVICES
Custom services are non-refundable once started.
Partial refunds based on progress are only available under the exceptions described in Section IV.

No credits, discounts, future refunds, or compensations will be granted.

VI. PROJECTS PAUSED OR ABANDONED BY THE CLIENT

If the Client:

  • Fails to provide requested information
  • Does not respond within agreed deadlines
  • Does not deliver requested materials
  • Abandons the project for more than 14 consecutive days

PYSTACK may administratively close the project.

In these cases:

  • No refunds will be issued
  • Only work completed up to the last active work date will be delivered
  • To reactivate the project, the Client must contract a new service or request an additional quotation (this is not a replacement or compensation)

VII. REFUND REQUEST PROCESS

To request a refund, the Client must send an email to: info@pystacklabs.com, including:

  • Full name or company name
  • Proof of payment
  • Contracted service
  • Reason for cancellation
  • Approximate date of request

PYSTACK will evaluate the request and respond within 10 business days.
Refunds will be processed within fifteen (15) business days after confirmation of cancellation, with credited amounts reflected according to the policies and timing of the bank or card issuer used.

Refunds will be issued using the same method originally used for payment.

VIII. NO COMPENSATIONS OR FUTURE BENEFITS

For absolute clarity:

  • NO credits for future services will be granted
  • NO compensations will be made
  • NO bonuses or discounts will substitute a refund
  • NO “balance in favor” will accumulate
  • Services contracted are not replaceable by other services

The only remedy is a partial refund based on actual progress, when applicable.

IX. MODIFICATIONS TO THIS POLICY

PYSTACK may modify this Policy at any time to accommodate operational, legal, or commercial changes.
Updated versions will be available at: https://pystacklabs.com

Continued use of services after publication constitutes acceptance of the updated Policy.
